Plain-English terms for using keysz.

These Terms of Service (“Terms”) govern your use of the keysz mobile app, the website at www.keysz.com, the partner portal and any related services (the “Services”) provided by keysz (“keysz”, “we”, “us”).

By creating an account, downloading the app or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

• You must be at least 18 years old and able to enter a binding contract.
• You must provide accurate information and keep your login details secure. You are responsible for all activity under your account.
• One account per person. Accounts may not be shared, sold or transferred.
• We may suspend or close accounts that breach these Terms or are used for fraud, abuse or unlawful activity.

keysz gives property buyers research, evidence-based price guidance and access to licensed buyer advocates. keysz acts only for buyers and never for vendors or selling agents.

keysz is not a licensed estate agent, conveyancer, lawyer, building inspector, financial adviser or valuer, and nothing in the Services is legal, financial, building or valuation advice. Where you need such advice, engage a suitably qualified professional.

Property reports, price ranges, risk flags, ownership-cost estimates and document summaries are produced with the assistance of artificial intelligence, drawing on third-party data sources and the documents you supply.

• AI outputs are guidance only. They may be incomplete, out of date or wrong.
• Price guidance is an estimate, not a valuation, and does not predict what a property will sell for.
• You must independently verify any information before relying on it, including by reading the full contract of sale, obtaining inspections and taking professional advice.
• You are responsible for any decision to bid, offer, negotiate or purchase.

When you request human help, keysz matches you with an independent buyer advocate who holds the licence or registration required in the relevant state or territory. The advocate acts for you under a separate engagement, and the scope, fee and authority (for example to bid at auction) will be confirmed with you in writing before work begins.

keysz facilitates the engagement and processes payment but does not itself provide licensed estate-agency services. Advocates are responsible for their own professional conduct and insurances.

• Prices are shown in Australian dollars and include GST unless stated otherwise. Prices may change; the price shown at checkout applies to that purchase.
• Payments are processed by Stripe. Purchases made through the Apple App Store or Google Play are subject to that store's payment and refund terms.
• Reports and add-ons are delivered digitally and are generally non-refundable once generated, except where required by the Australian Consumer Law or where we fail to deliver the product.
• Advocate engagements may be cancelled before work starts for a full refund. Once an advocate has started work, refunds are pro-rated at our reasonable discretion.
• Subscriptions (if offered) renew automatically until cancelled. You can cancel at any time and retain access until the end of the paid period.

Nothing in these Terms excludes any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

You retain ownership of documents, notes and other material you upload. You grant keysz a licence to store, process and analyse that material (including sending it to our AI and data providers) solely to provide the Services to you.

You must only upload material you are entitled to use. Do not upload content that is unlawful, infringes someone else's rights or contains another person's personal information without their consent.

• Use the Services only for your own genuine property purchase research.
• Do not scrape, bulk-download, resell or redistribute reports, data or any part of the Services.
• Do not reverse engineer, interfere with or attempt to gain unauthorised access to the Services or their data sources.
• Do not use the Services to harass, defame or mislead any person, or in breach of any law, including real estate and consumer laws.
• Do not use automated means to access the Services without our written permission.

The Services draw on third-party sources including property listing pages you supply, property and market data providers, government planning data and mapping services. That content remains the property of its owners and is subject to their terms. keysz does not guarantee the accuracy or availability of third-party data and may change or remove data sources at any time.

The Services, including the keysz name, logo, app, website, report formats, software and content we create, are owned by or licensed to keysz and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the app and the reports you purchase for your own property research. All other rights are reserved.

To the maximum extent permitted by law, the Services are provided “as is” and we exclude all warranties not expressly set out in these Terms. We do not warrant that the Services will be uninterrupted, error-free or that any report will be accurate or complete.

To the maximum extent permitted by law, keysz is not liable for any loss or damage (including loss of opportunity, overpayment on a property, or reliance on any report or advocate advice) arising from your use of the Services, and our total liability to you for any claim is limited to the amount you paid keysz for the product or service giving rise to the claim in the 12 months before the claim.

Where liability cannot be excluded under the Australian Consumer Law, it is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied.

You may stop using the Services and delete your account at any time from the app or by contacting us. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive (including 4, 7, 10 and 11) continue after termination.

We may update these Terms from time to time. Material changes will be notified in the app or by email at least 14 days before they take effect. Continuing to use the Services after that date means you accept the updated Terms.

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
